Time-lapse Tuesday: Milky Way forms in fine detail

Sandrine Ceurstemont, video producer

This epic time-lapse shows the Milky Way forming and evolving over 13.7 billion years (see video above). Developed by a team led by Piero Madau from the University of California in Santa Cruz and Javiera Guedes from the Institute of Theoretical Physics in Zurich, it's the most detailed simulation of a galaxy's evolution yet made. Unlike previous attempts, the massive galaxy that appears closely resembles the Milky Way - with its central strip of bright stars surrounded by spiral arms swirling in a flat disc.

The movie is based on a physics simulation of a single galaxy where powerful supercomputers were used to crunch numbers for nine months. "The simulation follows the interaction of more than 60 million particles of dark matter and gas," says Madau. The high resolution allowed star formation to be modelled more precisely, making the simulation more successful than previous models, which produced a central bulge of stars much larger than what is actually observed.

Since stars form in dense clouds of gas, simulating the process in greater detail ensures that they only appear in these regions, creating a more realistic distribution of stars in a galaxy. In earlier, lower-resolution simulations, stars were allowed to form in less-dense regions, meaning they were sprinkled more evenly throughout the galaxy.

The change produced a smaller central bulge of stars because when stars in the densely packed region exploded as supernovae, they blew away gas that could form later generations of stars - and a larger bulge.

The simulation uses the leading theory that slow-moving, or cold, particles of dark matter clumped together in the early universe, forming the scaffolding around which galaxies and clusters of galaxies then took shape.

For more on how galaxies formed, check out this simulation of the early universe or see what it might look like to travel into a cluster of galaxies.

Family Heart Disease Risk Linked to Genes, Not Lifestyle (HealthDay)

TUESDAY, Aug. 30 (HealthDay News) -- Genes affect hereditary coronary heart disease risk but family lifestyle does not, according to a new study.

While it's long been known that hereditary factors influence this risk, it hasn't been clear whether this is due to genes or unhealthy lifestyle in the family, the Swedish researchers said.

In order to answer that question, the investigators examined the health records of 80,214 adopted men and women in Sweden who were born in 1932 or later and developed coronary heart disease between 1973 and 2008. The researchers also studied the participants' adoptive and biological parents.

Adopted people with at least one biological parent with coronary heart disease had a 40 to 60 percent higher risk of coronary heart disease than people in a control group.

There was no increased risk for people with one or two adoptive parents who had coronary heart disease, the researchers reported in the August issue of the American Heart Journal.

"The results of our studies suggest that the risk of coronary heart disease is not transferred via an unhealthy lifestyle in the family, but rather via the genes," study leader Kristina Sundquist, a professor at the Center for Primary Health Care Research in Malmo, Sweden, said in a journal news release.

"But that does not mean that one's lifestyle is not a factor in one's own risk of developing coronary heart disease," she added.

Lifelock Getting Picked

Since February 2008, Lifelock, the company that guarantees that your identity will not be stolen has been hammered by legal problems. Lifelock charges consumers a month for the privilege of allowing the company to manage your Fair Credit Reporting Act right to a free initial security alert and which automatically opts out a consumer from pre-approved credit offers for six months. The Lifelock website states:

LifeLock, the industry leader in proactive identity theft protection, offers a proven solution that prevents your identity from being stolen before it happens. We?ll protect your identity and personal information for only a month ? and we guarantee our service up to ,000,000. Lifelock website

A consumer must know what it is they are shopping for and buying. Part of the education of the consumer comes from the vendors or retailers where the consumer shops. Lifelock, as quoted above claims that their product ?prevents your identity from being stolen before it happens?. Prevents? Come again? It would make sense to say, in the careful speech of legalese, ?reduces the likelihood of identity theft? or ?works to protect your identity?. The word ?prevents? clearly implies a non-conditional protection. A consumer reading this, if he or she is able to overcome their natural inclination to say ?too good to be true? might jump at the opportunity to purchase such protection.

But can Lifelock truly prevent your identity from being stolen. Three legal actions aimed at Lifelock beg to differ. First, on February 13, 2008, the Montana Attorney General, Mike McGrath opened a civil investigation of Lifelock based upon the appearance of CEO Todd Davis?s Social Security Number in a full page advertisement in the Great Falls Tribune. Assistant Attorney General Jesse Laslovich is quoted as saying in an article in the same newspaper ?? there also are some businesses cropping up that may only claim to protect people from identity theft?, pointing out the nature of Lifelock?s business is the utilization of no-cost initial security alert placed on the credit file by the three credit repository agencies upon request. An additional concern implied by the Attorney General is that the advertisement including Davis?s Social Security Number may itself be contributing to attempted identity fraud, ?The Social Security number in the advertisement is registered to numerous people, Laslovich said. Thats probably because people see it and try to use it to open lines of credit, he added.? Great Falls Tribune

]]>

Lifelock?s second blow came from the credit repository Experian filing a civil suit in the Federal District Court of Central California announced on February 21.

Experian?s suit alleges that Lifelock is abusing the Fair Credit Reporting Act right to an initial security alert, essentially comparing the use of the alert in a permanent fashion to crying wolf. The Fair Credit Reporting Act states in ? 605A (a)(1) that ?? a suspicion that the consumer has been or is about to become a victim of fraud or related crime, including identity theft,?? is the definition of an initial alert?s purpose.

Experian also claims that Lifelock?s advertising is ?false and misleading.? Another claim is that Lifelock?s ordering of credit reports for it?s customers (which are provided free of charge according to the Fair Credit Reporting Act when requesting an initial fraud alert, ? 612. Charges for certain disclosures (d) Free disclosures in connection with fraud alerts ) is being conducted ?without adequate disclosure?, meaning that consumers are unaware or are not told by Lifelock that the credit reports they receive are provided free by the credit repositories per federal law. Experian goes on to claim that companies are not legally able to place the fraud alerts for consumers which seems to be a stretch provided that consumers are authorizing the company to do so.

Experian?s most pertinent complaint involves the applying of initial fraud alerts without the imminent fear of or possibility of fraud. The credit bureau?s argument is that the protective nature of an initial security alert will be diminished if the alerts become too common place. Experian argues that creditors will essentially be forced to treat every initial alert as equal implying that eventually the alerts will be ignored.

Lifelock is counting on the practice that creditors will always place a telephone call to the consumer upon discovering the initial security alert. However, The Fair Credit Reporting Act does not require a creditor to make a telephone call to the consumer every time an initial security alert is found, but is permitted to ? take reasonable steps to verify the consumer?s identity and confirm that the application for a new credit plan is not the result of identity theft? meaning that it is possible that the use of database to verify the personal identifying information of the consumer probably suffices to meet the requirements of the law. If the database does not reflect new fraudulent activity, the alert may not work. Another possibility is to mail a letter to the consumer. Experian seems to have a good point.

Fair Credit Reporting Act

? 605A. Identity theft prevention; fraud alerts and active duty alerts [15 U.S.C. ?1681c-1]

(h) Limitations on Use of Information for Credit Extensions

(1) Requirements for initial and active duty alerts-

(B) Limitation on Users

(ii) Verification. If a consumer requesting the alert has specified a

telephone number to be used for identity verification purposes, before

authorizing any new credit plan or extension described in clause (i) in

the name of such consumer, a user of such consumer report shall

contact the consumer using that telephone number or take reasonable

steps to verify the consumer?s identity and confirm that the application

for a new credit plan is not the result of identity theft.

Lastly, on 28 March 2008 a class action suit was filed in Arizona against Lifelock alleging similar claims as the Experian suit:

The lawsuit alleges that the three-year-old company defrauds customers by offering services it cannot legally perform, and by touting a million guarantee that the suit alleges is wildly misleading. press release

The class action suit based upon Arizona?s Consumer Fraud Act and the Arizona Insurance Code alleges that Lifelock misleads the consumer by overstating the protection it affords and reiterates the Experian claim that Lifelock cannot legally order the consumer?s credit report. The class action suit also calls into question the highly advertised ,000,000 guarantee. The press release reports that the guarantee?s actual language is:

LifeLock will not pay any losses directly to the consumer and does not cover consequential or incidental damages to identity theft. The guarantee is limited to fixing failures or defects in the LifeLock services and paying other professionals to attempt to restore losses.

So a consumer who does become a victim of identity theft at the very least can claim remuneration from Lifelock for professional identity restoration services, something that could have been purchased on a monthly basis for not too much more than Lifelock?s fee from competitors of Lifelock.

Will Lifelock survive this legal onslaught? Are more suits or investigations coming? Only time will tell. What is for certain is that Lifelock?s attorneys are going to be very busy in 2008. Lifelock continues to secure funding from prominent industry financial leaders such as Goldman Sachs Group Inc most recently million in January 2008.

How much of this last funding round will be spent in legal fees or payouts remains to be seen.

92% Midnight in Paris

All Critics (151) | Top Critics (42) | Fresh (137) | Rotten (12)

Midnight in Paris is a loving embrace of the city, of art and of life itself.

Our hero has found his groove among the Lost Generation and, for us, there's some amusement to be had in sharing Gil's thrills -- it's like stepping into a Classic Comics version of A Moveable Feast.

Midnight in Paris is charming and clever, at times wickedly astute and hopeful.

There is breezy comedy to be made of a YouTube-age writer meeting the icons and idols of a bygone, classical era, but Allen goes deeper, expanding on his time-travel device to make unexpected and unexpectedly generous observations.

Woody Allen attracts promising players and does nothing with them.

I find this upfront fantasy to be his funniest, most agreeable comedy in years.

Sadly, this movie made me want to go back in time to a glorious period in New York City in the 1970s and '80s when a filmmaker named Woody Allen ruled the movie world.

Midnight in Paris finds exactly the right groove for its story and stays there. It's a winner.

A few rough patches aside, I found Midnight in Paris to be a delight

"Midnight in Paris," a parable about romanticism and nostalgia, recalls Early Owen as much as Early Woody.

This is [Allen's] most satisfying film in decades, a film with wit and ideas that is primarily about romanticism, illusion, and nostalgia.

What an enchanting movie - almost as enchanting as its location.

As befits Woody Allen, Midnight in Paris. is chock-full of cultural homages: Hemingway and Stein are just a small sample of the legends Allen parades onscreen.

A trifle filled with nostalgia and fantasy touristy fare.

Go in blind, and let it gobsmack you into euphoria.

A beautiful little jewel of a movie, and I'm thrilled to realize that Woody Allen still has films this good inside of him.

Literate and funny, light-hearted yet frequently eloquent

In the end it's about seeing through the illusion of nostalgia and yet not being disillusioned ? about cherishing the past, while living in the present.

Allen in top form with Midnight in Paris.

Woody Allen's most entertaining comedy in years...

Ao abordar a insatisfa??o do protagonista com o presente em fun??o de seu romantismo irrecuper?vel, o veterano diretor garante o sucesso tem?tico de Meia-Noite em Paris.

'Midnight in Paris' is rewarding if not fully satisfying and indicates that, now closer to 80 than 70, the writer-director has found peace with life as he finds it.

This isn't a good Woody Allen movie. No, this is one of the great Woody Allen films.

Let's face it, Woody Allen makes some bad movies or at least only slightly entertaining movies. He might have been great in the past but that day has long gone.

(AP) ? Slow-moving Typhoon Nanmadol remained dangerous Sunday despite weakening as it struck the tip of the mountainous northern Philippines, leaving at least eight people dead and scuttling a visit by a U.S. Navy battleship group, officials said.

Taiwan issued sea and land warnings and planned to evacuate about 6,000 people in its eastern and southern regions as it braced for the typhoon. Troops and rescue equipment were deployed for any contingency, Taiwan's Defense Ministry said.

With its enormous cloud band, the typhoon drenched the northern Philippines with rain for days before pummeling the area with fierce winds, setting off landslides and floods and knocking down walls that left at least eight people dead and six others missing, said Benito Ramos, who heads the Office of Civil Defense.

Strong winds knocked down a concrete wall which hit a small eatery in the capital's suburban Quezon City on Sunday, killing a man and injuring two others, police said.

In the northern mountain resort city of Baguio, a garbage dump's concrete wall collapsed and buried three shanties under tons of garbage Saturday, killing two children. Their grandmother remained missing, Ramos said.

Five others perished in landslides or drowned, including a fisherman whose body was found floating Saturday off eastern Catanduanes province. A decision by many villagers to flee to safety before the typhoon struck and vigilance helped reduce the number of casualties, Ramos said.

In northern Benguet province, bus driver Reynaldo Carlos ordered his passengers to flee Saturday after seeing mud, debris and boulders surging down a mountainside toward the vehicle, which was stuck on a muddy road.

The bus, its engine still running, was swept down a 200-foot (60-meter) ravine after everyone escaped, officials said.

"I was trembling with fear after I realized how close we were to death," Carlos told The Associated Press by telephone.

About 20 landslides blocked roads in Benguet, a gold-mining region about 130 miles (210 kilometers) north of Manila. More than 57,000 villagers fled their homes there and in 10 other northern provinces at the height of the typhoon, officials said.

U.S. officials postponed a Manila visit by the U.S. Navy's John C. Stennis Carrier Strike Group originally scheduled for this weekend because of the bad weather.

The U.S. Embassy said all tours of the aircraft carrier, as well as a reception on board, had been canceled.

Domestic airlines also canceled more than a dozen flights to areas affected by the typhoon in the northern and central Philippines.

Nanmadol had sustained wind of 121 miles (195 kilometers) per hour and gusts of 143 mph (230 kph) Friday, becoming the strongest typhoon to hit the Philippines so far this year. It weakened after grazing northern Cagayan province Saturday. It was expected to skirt the northernmost Batanes islands with 75 mph (120 kph) winds Sunday before starting to blow away from the country, Philippine government forecasters said.

Nanmadol was expected to hit Taiwan as early as Monday, Taiwan's central weather bureau said. It urged residents to prepare for strong winds and torrential rain, and warned there could be landslides in mountainous regions and flooding in low-lying areas.

On Sunday, TV footage showed parts of eastern and southern Taiwan drenched with rain. Strong winds blew a van across a road in the eastern Taiwanese county of Taitung.

Ferries connecting Taiwan's mainland to islets and some domestic flights were canceled. Train service in southern and eastern Taiwan was to be suspended, and two major roads in eastern and central Taiwan were to be closed starting late Sunday afternoon.

Two eastern Taiwanese counties said people did not have to go to school or work on Monday.

Prostate Cancer Prevention that's Free, Effective & Mandatory For ...

Prostate cancer prevention is never a 100% sure thing. Men who thought they would never get it have gotten it. Even guys with low PSA scores sometimes get the disease ? even though they eat right, exercise and follow all the usual health rules.

But, there is one thing most of these men don?t do.

And, if they simply did more of it, would probably never have to worry about getting cancer in their prostate.

What is this thing most men are missing?

Getting enough sunshine.

Very simple, isn?t it?

Yes, it?s simple ? but also powerful for prostate cancer prevention.

The power of sunshine is in the vitamin D your body produces as a result of being in the sun. This vitamin D is extremely potent. In fact, I?ve heard respected doctors say that if the vitamin D in the sunshine (that you can?t get in a pill) were bottled and patented, it would be marketed as a prostate cancer cure.

But it is not just prostate cancer it is good for.

It is good for other kinds of cancers and diseases, too.

Certainly, obviously, this doesn?t mean you can go out in the sun for ten hours per day and be okay.

Like anything, you have to use common sense and moderation.

For example, if you?re someone who burns easily, then you?ll want to limit your exposure as compared to someone who can be out in the sun longer.

The point is, to get sunshine often, even if in short doses of fifteen minutes at a time.

It is one of the best prostate cancer prevention discoveries ever made.

Irene churns up coast, weaker but still ferocious (AP)

NAGS HEAD, N.C. ? Weaker but still menacing, Hurricane Irene knocked out power and piers in North Carolina, clobbered Virginia with wind and churned up the coast Saturday to confront cities more accustomed to snowstorms than tropical storms. New York City emptied its streets and subways and waited with an eerie quiet.

With most of its transportation machinery shut down, the Eastern Seaboard spent the day nervously watching the storm's march across a swath of the nation inhabited by 65 million people. The hurricane had an enormous wingspan ? 500 miles, its outer reaches stretching from the Carolinas to Cape Cod ? and packed wind gusts of 115 mph.

Almost 900,000 homes and businesses were without power. While it was too early to assess the full threat, Irene was blamed for three deaths. A North Carolina man was struck by a flying tree limb, someone in Virginia was killed when a tree fell on a car, and an 11-year-old boy in Virginia died when a tree crashed through his apartment building.

The hurricane stirred up 7-foot waves, and forecasters warned of storm-surge danger on the coasts of Virginia and Delaware, along the Jersey Shore and in New York Harbor and Long Island Sound. In the Northeast, drenched by rain this summer, the ground is already saturated, raising the risk of flooding.

Irene made its official landfall just after first light near Cape Lookout, N.C., at the southern end of the Outer Banks, the ribbon of land that bows out into the Atlantic Ocean. Shorefront hotels and houses were lashed with waves. Two piers were destroyed, and at least one hospital was forced to run on generator power.

"Things are banging against the house," Leon Reasor said as he rode out the storm in the town of Buxton. "I hope it doesn't get worse, but I know it will. I just hate hurricanes."

By afternoon, the storm had weakened to sustained winds of 80 mph, down from 100 mph on Friday. That made it a Category 1, the least threatening on a 1-to-5 scale, and barely stronger than a tropical storm. Its center was positioned almost exactly where North Carolina meets Virginia at the Atlantic, and it was moving more slowly, at 13 mph, and back out toward the ocean.

After the Outer Banks, the storm strafed Virginia with rain and strong wind. It covered the Hampton Roads region, which is thick with inlets and rivers and floods easily, and chugged north toward Chesapeake Bay. Shaped like a massive inverted comma, the storm had a thick northern flank that covered all of Delaware, almost all of Maryland and the eastern half of Virginia.

It was the first hurricane to make landfall in the continental United States since 2008, and came almost six years to the day after Katrina ravaged New Orleans. Experts guessed that no other hurricane in American history had threatened as many people.

At least 2.3 million were under orders to move to somewhere safer, although it was unclear how many obeyed or, in some cases, how they could.

Defense Secretary Leon Panetta told 6,500 troops from all branches of the military to get ready to pitch in on relief work, and President Barack Obama visited the Federal Emergency Management Agency's command center in Washington and offered moral support.

"It's going to be a long 72 hours," he said, "and obviously a lot of families are going to be affected."

In New York, authorities began the herculean job of bringing the city to a halt. The subway began shutting down at noon, the first time the system was closed because of a natural disaster. It was expected to take as long as eight hours for all the trains to complete their runs and be taken out of service.

On Wall Street, sandbags were placed around subway grates near the East River because of fear of flooding. Tarps were placed over other grates. Construction stopped throughout the city, and workers at the site of the World Trade Center dismantled a crane and secured equipment.

While there were plenty of cabs on the street, the city was far quieter than on an average Saturday. In some of the busiest parts of Manhattan, it was possible to cross a major avenue without looking, and the waters of New York Harbor, which might normally be churning from boat traffic, were quiet before the storm.

The biggest utility, Consolidated Edison, considered cutting off power to 6,500 customers in lower Manhattan because it would make the eventual repairs easier. Mayor Michael Bloomberg also warned New Yorkers that elevators in public housing would be shut down, and elevators in some high-rises would quit working so people don't get trapped if the power goes out.

"The time to leave is right now," Bloomberg said at an outdoor news conference at Coney Island, his shirt soaked from rain.

A day earlier, the city ordered evacuations for low-lying areas, including Battery Park City at the southern edge of Manhattan, Coney Island with its famous amusement park and the beachfront Rockaways in Queens.

The five main New York-area airports ? La Guardia, John F. Kennedy and Newark, plus two smaller ones ? waved in their last arriving flights around noon. The Giants and Jets postponed their preseason NFL game, the Mets postponed two baseball games, and Broadway theaters were dark.

New York has seen only a handful of hurricanes in the past 200 years. The Northeast is much more used to snowstorms ? including the blizzard last December, when Bloomberg was criticized for a slow response.

For all the concern, there were early signs that the storm might not be as bad as feared. Some forecasts had it making landfall as a Category 3 storm and perhaps reaching New York as a Category 2.

"Isabel got 10 inches from coming in the house, and this one ain't no Isabel," said Chuck Owen of Poquoson, Va., who has never abandoned his house to heed an evacuation order. He was referring to Hurricane Isabel, which chugged through in 2003.

Still, Owen put his pickup truck on a small pyramid of cinder blocks to protect it from the storm tide, which had already begun surging through the saltwater marshes that stand between Poquoson and Chesapeake Bay.

Airlines said 9,000 flights were canceled, including 3,000 on Saturday. Airlines declined to say how many passengers would be affected, but it could easily be millions because so many flights make connections on the East Coast. There were more than 10,000 cancellations during the blizzard last winter.

American Airlines spokeswoman Andrea Huguely said it was not clear when flights would resume out of New York.

"The one thing about a hurricane is that you can prepare for it and you just have to adapt your plan based on how the storm travels," she said. "It's basically an educated guessing game."

Greyhound suspended bus service between Richmond, Va., and Boston. Amtrak canceled trains in the Northeast for Sunday.

The power losses were heavily concentrated in Virginia and North Carolina, where Irene charged ashore early Saturday morning. Dominion Resources reported almost 600,000 customers without power and Progress Energy 260,000, with much of the outages in Wilmington and Wrightsville Beach, N.C.

Irene roared across the Caribbean earlier this week, offering a devastating preview for the United States: power outages, dangerous floods and high winds that caused millions of dollars in damage.

What countries tax the property held by ... - Finance Assistant

August 25th, 2011

It seems to me that these organizations use the resources of the community as much as anyone else: Police, Fire, EMS, Street maintenance, Water, Sewage? And to the extent that they do not share in the tax burden the rest of us have to pay more than our fair share.

In the US, the Supreme Court ruled that it is not unconstituional to tax a church. (Walz v. Tax Commission of the City of NY (1970))

In fact, if tax exemption is a form of subsidy, then church property tax exemption is a clear violation of the establishment clause of the First Amendment.

AirPlay drives iTunes momentum in online movie market share

A new report from research firm IHS suggests that Apple?s iTunes share of ?consumer spending for movie electronic sell-through (EST) and Internet video on demand (iVOD)? grew during the first half of 2011, the first time since 2009, despite an increase in competition from Walmart and Amazon. iTunes had a 65.8% market share during the first half of this year, up from 64.9% during the first half of 2010. It also had the largest increase in revenue growth among its competitors. ?Much of iTunes? success can be traced to the rising usage of Apple?s AirPlay system, which allows wireless video streaming to consumer electronic devices including televisions,? said IHS research director Arash Amel. ?This has expanded the reach of iTunes to new platforms, boosting sales of movies from the system.? Microsoft?s Zune Video Marketplace maintained the second largest share of consumer spending in the market with a 16.2% share, down from 18.5% during the first half of 2010. Walmart?s Vudu service saw the largest share increase among market leaders: it jumped from a 1% share during the first half of last year to a 5.3% share during the first half of 2011. Sony?s PlayStation Store now has a 4.4% share, down from 8.2%, and Amazon?s share grew slightly from to 4% from 4.2%. Read on for the full report.

iTunes Gains Share in Online Movies in First Half of 2011

Reversing its previous declines in market share, iTunes in the first half of 2010 managed to pad its leadership position in the U.S. online movie market, according to the new IHS Screen Digest Media Research from information and analysis provider IHS (NYSE: IHS).

iTunes? share of U.S. consumer spending for movie electronic sell-through (EST) and Internet video on demand (iVOD) rose to 65.8 percent in the first half of 2011, up from 64.9 percent for ?the same period in 2010. The expansion contrasts with the first half of 2010 when the share held by Apple Inc.?s iTunes declined by 11.9 points year-on-year. In fact, the first half of 2011 marked the first increase in share for iTunes since two years ago in 2009.

Notably, iTunes experienced the largest revenue increase growth among all online movie providers during the first half.

?iTunes? expansion of its market lead represents a remarkable achievement in light of intensifying competition from a slew of aggressive rivals,? said Arash Amel, research director, digital media, for IHS. ?Much of iTunes? success can be traced to the rising usage of Apple?s AirPlay system, which allows wireless video streaming to consumer electronic devices including televisions. This has expanded the reach of iTunes to new platforms, boosting sales of movies from the system.?

Other factors that enhanced iTunes? share included the growing installed base of the iPad and price promotions.

Vudu?s Market Share Voodoo
Along with Apple?s market share advance, the other big success story among the major online movie stores in the first half was Wal-Mart?s Vudu. Vudu?s share of EST and iVOD movie revenue rose to 5.3 percent in the first half of 2011, up from 1.0 percent during the same time in 2010. This allowed Vudu to rise to the No. 3 position earlier this year, up from fifth place. ??Just as IHS predicted in its February release, Vudu has emerged as a major market rival to established players like Apple and Sony,? Amel said. ?Vudu?s gains were driven by several factors, including its shrewd device strategy, a good customer experience, a compelling user interface and its $1/$2 rental pricing system.?

Microsoft and Sony Face Challenges
The No. 2 online movie store, Microsoft?s Zune Video Marketplace, lost market share in the first half, declining to 16.2 percent, down from 18.5 percent during the same period in 2010. The company had enjoyed a market share surge during the 2010 holiday season courtesy of the strong sales of the Kinect, a motion-sensing system for the Xbox 360. Kinect helped improve sales at that time of the Xbox, which can access movies on the Zune Video Marketplace. However, the impact of the surge since has dwindled, causing Zune?s share to decline.

For Sony, its PlayStation Store accounted for 4.4 percent of iVOD and EST movie share in the first half, down from 8.2 percent in 2010. This caused the PlayStation Store to drop to the fourth position, down from third place, which it had long occupied.

?The PlayStation Store fell out of the Top 3 rankings chiefly because Vudu cannibalized its market share,? Amel said. ?Furthermore, the global security breach that shut down Sony?s online gaming operations during a major portion of the first half had a deleterious impact on the PlayStation Store?s business.?

In the case of Amazon, a boost in revenue to reach 4.2 percent in the first half, up from 4.0 percent in 2010, was not enough to keep it in the No. 4 rank, as the surge from Vudu pushed the online retailer down to fifth place. The company in the first half was engaged in a shift in its business to streaming video on demand (SVOD) and Amazon Prime.

Online Movie Business Focuses on EST
Together, the U.S. iVOD and EST business in the first half of 2011 amounted to $229 million, with EST accounting for $118 million and $111 million for iVOD. For the full year of 2011, IHS predicts the market will rise to $487 million, with EST representing $247 million, and iVOD taking up $240 million.

?The new-release on-demand business is all about iVOD,? Amel said. ?In the current economic climate, consumers are more interested in accessing movies than in owning them. Because of this, growth in EST has virtually stopped. Whatever small EST growth that is happening is coming from aggressive sales on iTunes, as well as discounting across major services.?

Business Leaders Fail To Prepare For Disaster Recovery ...

Business continuity planning life cycle

Image via Wikipedia

The growth of a successful business is rarely rapid, but its demise may well be.

According to statistics supplied by the Business Continuity Institute more than 40% of businesses do not recover following a terrorist attack or, I suspect, civil riots. In fact, the demise of the business could be overnight!

So why is it that, more than 53% of businesses have failed to put together a Business Continuity Plan? Is it that the business leaders are complacent, inept perhaps? I?ve had a number of conversations with CEO?s and Managing Directors who have volunteered that their recovery plan is to work from home on their laptop, keeping contact with other business colleagues who are likewise working from home, until they can re-group.

?Expecting the Unexpected Business continuity in an uncertain world ? a booklet published by the UK?s National Counter Terrorism Security Office, London First and the Business Continuity Institute as far back as 2003 defined business continuity management as:

?A holistic management process that identifies potential impacts that threaten an organisation and provides a framework for building resilience with the capability for an effective response that safeguards the interests of its key stakeholders, reputation, brand and value-creating activities.?

Laptop ? Home?.I think not.

Having a robust, proven business continuity plan is absolutely fundamental to a professional, well run organisation. Size has no part to play in this, big or small, there is no excuse for not expecting the unexpected. The aims and objectives of the plan should be hammered out and agreed at the outset and everyone within the organisation should not only know what to expect but be encouraged to actively contribute to the plan. The fact that you have taken the time to prepare for recovery is a factor that should be commonly known and shown. This is important for two main reasons.

Firstly, because in the search for recognition and support, in these competitive times, potential investors, customers and service/product users will want to know that the business is sustainable and can continue to perform through adversity. Secondly, each member of the organisation will have his or her own ?hidden? concerns and worries. They need to feel that their overall contribution to the business success is seen as worthwhile and that they will continue to have a job, a wage and continuity of employment. That?s the responsibility of quality business leaders, there?s nothing worse than dissent and lack of confidence in a workforce and in uncertain times it is the leadership that has to remain steadfast, laptops at home is not steadfast leadership.

Critical Path Planning.

Planning is a relatively simple process, initially taking into consideration three main areas, People, Physical Assets and Systems. This in mind, the start can be an uncomplicated affair, a pencil, piece of paper and quiet corner is all that is needed. Pause for a while, and let your mind think about the possible outcomes if you do not have a plan. You could lose your business position as your competitors move in on your customers, taking advantage of your inability to perform leading to a loss of reputation, not to mention the effect on your staff and loss of expertise, also, possibly to your competitors as your workforce migrates to those who did have a plan. Then there is the probable health and safety claims and the inevitable increase in insurance policies, for the future, if there is a future.

Having realised the effect of not having a plan you now need to begin the process of putting one together. This is universally recognised as a five point checklist beginning with, Analysis of the Business, and secondly Assessing the Risk both of these you will know better than anyone else. Developing your strategy is the third stage and here you could bring in outsiders with relevant experience. That experience may well be worth the investment as the fourth and probably most crucial stage is the actual Development of the Plan. Finally, you should rehearse your plan to ensure that it is in fact workable. For example, let us say that your plan includes using a ?Hot Site? agreement. This is office space with equipment usually provided by specialist continuity companies such as Internet Central based at Keele University in the UK. They advocate that they will have desks and facilities available within four hours of the need arising. It is no use waiting for the disaster to happen and then expecting your plan to work. You need to test and experience the plan in the cold light of day without the trauma. Once tested you may well have to go back to the paper and pencil stage and re-think your plan. But that is certainly better than it going wrong at a critical moment.
